Judicial Challenge Over Guard Activation
In an emergency filing, the federal legal authorities asked the bench to reverse a lower court ruling that had blocked the sending of several hundred state guard troops to the Chicago region.
The federal judge had expressed skepticism about the government's explanation for sending troops, challenging its explanation in given local conditions.
A higher court supported the lower court’s decision on Thursday, leaving the activation on pause while the legal challenge moves forward.
Administration's Claims
The top government lawyer, acting for the White House, stated in the new filing that federal agents have repeatedly been “threatened and targeted” in downtown Chicago and the outlying area of Broadview community.
This site is home to an ICE holding center.
The commander-in-chief has already dispatched national guard units to Chicago, Illinois and the city of Portland, after earlier activations to LA, the city of Memphis, and Washington, District of Columbia.
The president has claimed that military intervention is required to curb unrest and strengthen border control.

Elected Democrats have vehemently criticized the move, saying that the White House's statements are greatly exaggerated and partisan in nature.

City officials claim that demonstrations over deportation policies have been largely limited and non-violent, challenging the administration's characterization of “war zone” conditions.
Legal Basis
At the center of the conflict is the administration's application of a federal statute authorizing the president to take control of the national guard only in situations of uprising or when “powerless with the regular forces to enforce the laws of the United States”.
The government argues that the forces are necessary to defend government buildings and agents from protesters.

In recent weeks, the White House took control of several hundred personnel of the state guard of Illinois and commanded additional guard from Texas personnel into the Illinois.
As state authorities criticized the move, the former president intensified his language, urging the detention of Chicago’s mayor and the state's chief executive, each a Democrat, alleging them of failing to secure federal agents.
The state of Illinois and Chicago together took legal action against the administration to block the activation.
On October 9, district Judge April Perry, a Biden appointee, delivered a preliminary order preventing the command.
